PRIVACY POLICY/ CA PRIVACY RIGHTS

This is an agreement between you and the Company. Please read these Terms & Conditions, the Privacy Policy and the other applicable rules, policies, and terms available at the JNCO.com website, or on or through the JNCO Software (collectively, this “Agreement”) before using the JNCO Services or JNCO.com website. By using the Company Services, you agree to be bound by the terms of this Agreement. If you do not accept the terms of this Agreement, then you may not use the JNCO Services or the JNCO.com website and you may return your purchase in accordance with any applicable return policy. Your use of any of the JNCO Services and the JNCO.com website is subject to any additional rules, policies, and terms that apply to those JNCO Services.

American Textile Association LLC, DBA, JNCO Los Angeles, and its respective subsidiary and affiliated companies (“Company” or “we” or “us” or “our”) have created this privacy policy (this "Privacy Policy") in order to demonstrate its commitment to user, visitor, subscriber, and customer privacy with regard to the JNCO Los Angeles website located at JNCO.com and any affiliated Sites (together, collectively the "Site"). Privacy on the Site is of great importance to us. Because we may gather some important information from our users, visitors, subscribers and customers (collectively “you” or “your”), we have established this Privacy Policy as a means to communicate our information gathering and dissemination practices.

We are committed to protecting the privacy of our users and the information that you share in connection with our Site. This Privacy Policy identifies: (i) what information we collect; (ii) how we process and manage such information; (iii) your rights with respect to the use and disclosure of the same. 1. UPDATES

From time to time, this Privacy Policy will be updated in whole or in part, at which time the new date will be reflected above in the “Last Revised” section. The updated Privacy Policy will immediately replace and supersede any prior Privacy Policy, unless otherwise noted. Accordingly, if you use the Site after an update is published, then you will unconditionally and automatically agree to be bound by the updated Privacy Policy.

 2A. What Personal Information Do We Gather?

 The information we learn from you helps us personalize and continually improve your experience. Here are the types of information we gather.

  • Information You Give Us: We receive and store any information you enter on our Site or give us in any other way. You can choose not to provide certain information, but then you might not be able to take advantage of many of our features. We use the information that you provide for such purposes which include but is not limited to responding to your requests, customizing future shopping for you, and communicating with you.
  • Automatic Information:  We receive and store certain types of information whenever you interact with us. For example, like many websites, we use "cookies," and we obtain certain types of information when your Web browser accesses JNCO.com or advertisements and other content served by or on behalf of JNCO.com on other Web sites. 
  • Mobile: When you download or use apps created by JNCO or our subsidiaries, we may receive information about your location and your mobile device, including a unique identifier for your device. We may use this information to provide you with location-based services, such as advertising and other personalized content. Most mobile devices allow you to turn off location services.
  • E-mail Communications: To help us make e-mails more useful, at times we may receive a confirmation when you open e-mail from JNCO.com if your computer supports such capabilities. We also compare our customer list to lists received from other companies, in an effort to avoid sending unnecessary messages to our customers.   • Information from Other Sources: We might receive information about you from other sources and add it to our account information. 

2B. PERSONAL DATA AND NON-PERSONAL DATA

  • “Personal Data” means data that allows someone to identify or contact you, including, for example, your name, address, telephone number, e-mail address, as well as any other non-public information about you that is associated with or linked to any of the foregoing data. Your Internet Protocol (“IP”) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session) may be considered Personal Data in certain Jurisdictions.
  • “Non-Personal Data” means data that is not associated with or linked to your Personal Data; Non-Personal Data does not, by itself, permit the identification of individual persons. We collect Personal Data and Non-Personal Data, as described below.

3. ONLINE TRACKING (“COOKIE POLICY”)

Like many websites, the Site uses various industry-standard tracking technologies, such as cookies, click re-directs, web beacons, tag technology, device identifiers, IP address, etc. to remember your device, track your usage patterns, to tailor your internet-based advertising, or to enhance or personalize your online browsing and shopping experience. If you disable cookies or other tracking technologies, then certain features may be unavailable as a result.

  • What Personal Information is collected? We collect Personal Information that you voluntarily provide us, for example, when you create an Account, register for our newsletter and/or make a purchase we may require your name, email, contact information, billing address, credit card inform and/or other information you may provide us (“Personal Data” or “Personal Information”). We also collect information about you from various sources, including your IP address or from your in-store purchases. We also may collect information about you that we receive from other sources (like public records), to enable us to update and correct the information contained in our database and to provide product recommendations and special offers that we think will interest you.
  • Use of Personal Data. We may use your Personal Data in the following manner which includes but is not limited to the following:
  1. Make the Site available to you;
  2. Process and fulfill merchandise orders; 
  3. Enhance the Site;
  4. Respond to your requests or to manage Accounts;
  5. Monitor the security of the Site; and/or
  6. Provide you with promotional communications.
  • Non-Personal Information Collected by Our Servers. To make our Site more useful to you, our servers (which may be hosted by a third-party service provider) collect information from you, including but not limited to your browser type, operating system, domain name, and/or a date/time stamp for your visit.
  1. Log Files. As is true of most websites, we gather certain information automatically and store it in log files. This information includes but is not limited to IP addresses, browser type, Internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information in a manner which may include but not be limited to analyzing trends, administering the Site, tracking users’ movements around the Site, gathering demographic information about our user base as a whole, and better tailor our Site to our users’ needs. For example, some of the information may be collected so that when you visit the Site again, it will recognize you and the information could then be used to serve advertisements and other information appropriate to your interests.
  2. Like many online services, we use cookies to collect information. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing the Site.   3. Pixel Tags. In addition, we use “Pixel Tags” (also referred to as clear Gifs, Web beacons, or Web bugs). Pixel Tags may be embedded invisibly in Web pages. Pixel Tags may also allow us to send e-mail messages in a format user can read, and they may inform us whether e-mails have been opened to ensure that we are sending only messages that are of interest to our users. We may use this information in a manner to include but not be limited to reducing or eliminating messages sent to users. We generally do not tie the information gathered by Pixel Tags to Personal Data unless you are logged in to your account.
  4. Flash LSOs. When we post videos, third parties may use local shared objects (“LSOs”), known as “Flash Cookies,” to store your preferences for volume control or to personalize certain video features. Flash Cookies are different from browser Cookies because of the amount and type of data and how the data is stored. Cookie management tools provided by your browser will not remove Flash Cookies.   5. Google Analytics. We may use Google Analytics in a manner to include but not be limited to helping analyze how users use the Site. Google Analytics may use Cookies to collect information such as how often users visit the Site, what pages they visit, and what other sites they used prior to coming to our Site. We use the information we get from Google Analytics in a manner to include but not be limited to improving our Site. Google Analytics collects your location (e.g. City and Country) on the date you visit the Site. We reserve the right to combine the information generated through the use of Google Analytics with your Personal Data. Although Google Analytics plants at the least a persistent Cookie on Your web browser to identify you as a unique user the next time you visit the Site and use Services, the Cookie appears to not be able to be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to our Site is governed by the Google Analytics’ Terms of Use and Privacy Policy.

4. PRIVACY RIGHTS

You may modify the information you have provided to us through your Account. You can also opt-out of receiving marketing communications, deactivate, or delete your Account.  When you update or modify, deactivate or delete information, we usually keep a copy of the prior version for our records.

5. UNSUBSCRIBE

You will have an opportunity to unsubscribe to emails or mailings by clicking on an "unsubscribe" hyperlink contained in promotional emails we send you. Even if you are removed from any such list, if you use the services provided through the Site, you will continue to receive email correspondence from us related to the services. Any opt-out by you is not deemed valid until processed by us. It is your obligation to verify that you have been opted-out. We will not be liable for problems with the opt-out procedures. Please note that any request to be removed from such mailing lists may take at least one (1) week or longer to become effective. Even if you are removed from any such list, if you order online, we will send you an email confirming your order and may need to contact you by phone, email, or regular mail if we have questions about your order. When you unsubscribe, we usually keep a copy of the prior version for our records.

6. DISCLOSURE OF PERSONAL INFORMATION

We disclose Your Personal Data as described below and as described elsewhere in this Privacy Policy including but not limited to the following.

  • Third-Party Service Providers.We may share your Personal Data with third parties, such as vendors and service providers who provide assistance, including but not limited to,  With billing, payment processing, fraud protection, credit risk reduction, marketing, data analytics support and service associated with the Site and delivery of purchased merchandise.
  • Compliance with laws and for other legitimate business purposes.We will share your Personal Data when we believe disclosure is necessary or required by law, regulation, to protect users, the integrity of the Site and to defend or exercise our legal rights. 7. INFORMATION SECURITY AND CONFIDENTIALITY

We will strive to utilize appropriate organizational and technical measures designed to protect the security and confidentiality of information we process. However, no organizational or technical measures are fully or 100% secure so you must take care and utilize your own safe guards when disclosing information online and act reasonably to protect yourself online. In order to help protect your Personal Information further, you should take caution and care about providing your password to others. 8. SUSPICIOUS E-MAILS

We will never request your password, user name, credit card information or other Personal Information through email. For your protection, do not click links or open any files attached to suspicious, unsolicited emails.

9. CALIFORNIA DO NOT TRACK DISCLOSURE

Do Not Track is a privacy preference that users can set in their web browsers. When a user turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the user. At this time, we do not recognize or respond to Do Not Track browser settings or signals and we will still receive information. As a result, we may still collect information about you and your internet activity, even if you have turned on the Do Not Track signal.

It is possible that some or all of our third-party advertising partners or members of their affiliate network may participate in a consumer opt-out programs. 10. CALIFORNIA PRIVACY RIGHTS

Pursuant to the California Civil Code, residents of California have the right to request from a business, with whom the California resident has an established business relationship, certain information with respect to the types of Personal Information the business shares with third parties for direct marketing purposes by such third party and the identities of the third parties with whom the business has shared such information during the immediately preceding calendar year.

11. YOUR U.K. PRIVACY RIGHTS

Users from the U.K. may ask us to amend or limit the processing of their Personal Data, (as defined by U.K. law) and in particular not to process their Personal Data for marketing purposes. You can exercise your rights to prevent such processing by checking certain boxes on the forms we use to collect your Personal Data. You can also exercise the right at any time by contacting us at: cs@JNCO.com.

The U.K. Data Protection Act 1998 ("the DPA 1998") gives users from the U.K.  certain rights to access certain information about you. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.

12. INTERNATIONAL SITE USER RIGHTS AND THE GENERAL DATA PROTECTION REGULATION (“GDPR”)

The General Data Protection Regulation (“GDPR”) relates to the processing of certain personal data for Site users located in the European Economic Area ("EEA"), which includes the European Union (“EU”). Information collected in the EEA may be transferred, stored and processed by us and our services providers in the United States and other countries whose data protection laws may be different than the laws of your country. You may have found this Site through a Link located on a third-party website operated by another company or you may choose to click on a link on this Site to websites operated by third parties. For example, we may at times include links to various social media platforms on this Site, but know that if you interact with these social media tools through this Site, then your experience on those social media sites will be governed by the privacy and other policies of those sites and the privacy settings you have chosen on those sites will determine the degree to which your information is made public. In short, please be advised that the practices described in this Privacy Policy do not apply to information gathered through any website operated by other companies.
